Terms of Service

Last updated: 14.10.2026

Welcome to Tamidkan (the "Service"). The Service is operated by Ishai Nissim Zaffran (Israeli exempt dealer), business no. 324828300, Ashdod, Israel ("we", "us"). These Terms apply to every business that signs up for the Service and to every user acting on its behalf ("Customer", "you"). By signing up or using the Service you agree to these Terms and to our Privacy Policy. If the Hebrew and English versions differ, the Hebrew version prevails.

1. What the Service does

1.1. The Service is a web-based lead and customer management system for small businesses. It includes an embeddable intake form, a customer list (CRM), an approval inbox, and AI agents ("Agents") that prepare drafts of messages, reminders, quotes, review requests and content.

1.2. Agents prepare suggestions. By default, every message to your customers and every publication waits for your approval before it is sent. If you switch an Agent to "auto mode", you authorize it in advance to send or publish without separate approval for each action, and you are responsible for the result.

1.3. The first reply to a new lead is a fixed template you approve once in advance, and it is sent immediately when the lead arrives.

1.4. Every new account starts in "demo mode". In demo mode nothing is sent to real people and nothing is published.

1.5. The Service connects to third-party services you choose, such as Google Calendar, WhatsApp Business, Google Business Profile, Facebook, Instagram, WordPress, and SMS and email providers. Your use of those services is also subject to their terms. We are not responsible for their changes, outages or restrictions.

2. Artificial intelligence

2.1. Agents use AI models from a third-party provider (Anthropic). AI output may contain errors, inaccurate information or unsuitable wording.

2.2. Price estimates and recommendations shown to visitors on your website are preliminary only. You are responsible for setting correct price ranges in your business profile and for making clear to your customers that an estimate is not a binding offer.

2.3. The Service does not provide medical, legal, financial or other professional advice. If your business is in health or therapy, you must not use Agents to diagnose, recommend treatment or give medical instructions. Content they prepare is for marketing and operations only.

2.4. We do not use your customers' data to train AI models, and under its commercial terms our AI provider does not either.

3. Account

3.1. The Service is for businesses operating in Israel only, and for individuals over 18 who are authorized to act for the business.

3.2. You must provide accurate details and keep them up to date. You are responsible for keeping your login credentials confidential and for all activity in your account.

3.3. You may add users on behalf of your business. You are responsible for their actions.

4. Your responsibility for data and messages

4.1. You own your customer data. Under the Israeli Protection of Privacy Law, 5741-1981 (including Amendment 13), your business is the "database controller" for data about your leads and customers, and we are a "holder" that processes the data only on your instructions. See Appendix A.

4.2. You agree to:

4.3. You are responsible for the content of every message, publication or quote you approved or sent in auto mode.

5. Prohibited use

You may not use the Service to:

We may suspend an account that breaches this section, with prior notice where possible.

6. Subscriptions, free trial and payment

6.1. Plans: Basic (350 ILS per month, up to 4 Agents) and Pro (550 ILS per month, all Agents). Current prices are shown on our pricing page. We are an exempt dealer and do not charge VAT, so the price shown is the final price.

6.1a. Usage allowance: Every plan, including the free trial, includes a monthly Agent usage allowance that is enough for a typical small business. Your subscription screen shows how much of it was used this month. If you reach it, the Agents pause until the start of the next month, and new leads are still saved. Paid plans can add the "Unlimited" add-on (99 ILS per month).

6.1b. Fair use: The "Unlimited" add-on is subject to fair use. Excessive use means use several times that of a typical business in the same field, or use that is not for your own business (for example, reselling the Service). When usage approaches an excessive level, we will try to contact you in advance and offer a tailored plan. If usage keeps exceeding it, the Agents may pause temporarily until we agree, and new leads are still saved.

6.2. Free trial: 14 days free, with no card details. When the trial ends, the Agents stop until you choose a plan, and new leads are still saved. There is no automatic charge at the end of the trial. Charging starts only when you choose a plan and pay.

6.3. Payment provider: Payment is made on a secure page of Grow (Meshulam), an Israeli payment processor, by credit card, Bit or Apple Pay. We are the seller, not Grow. A receipt is emailed to you for every payment. Card details go to Grow only; we do not see or store them.

6.4. Renewal: Subscriptions renew automatically each month by standing order, on the same day of the month as your first payment, until cancelled. If a charge fails, Grow retries for up to 10 days and the Service keeps working meanwhile. The "Unlimited" add-on is added to the monthly sum from the next charge.

6.5. Price changes: We give at least 30 days' notice of a price change. You may cancel before it takes effect.

6.6. Third-party costs: Some connections (for example SMS or WhatsApp conversations beyond an allowance) may cost extra. We show the cost before you enable them.

7. Cancellation and refunds

7.1. You can cancel at any time in your account settings or by email at support@tamidkan.co.il. Cancellation takes effect at the end of the current billing period and you will not be charged again.

7.2. See our Refund Policy. If you are a "consumer" under the Israeli Consumer Protection Law, 5741-1981, your statutory rights also apply and prevail over these Terms.

8. Your data when the account closes

To close your account, email support@tamidkan.co.il. Before closing you can export your customer list from the app (Export to Excel). After closing we delete your data within 30 days, except data we must keep by law (such as accounting records) and backups, which are deleted in their normal cycle.

9. Intellectual property

9.1. The Service, code, design and marks belong to us. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.

9.2. Content you upload, and output Agents prepare for you (messages, posts, quotes), belongs to you. You permit us to use it only to provide the Service to you.

9.3. If you send us suggestions, we may use them without obligation to you.

10. Availability and changes

We make reasonable efforts to keep the Service available and working but do not guarantee uninterrupted availability. Maintenance and outages may occur. We may change or discontinue features. If we discontinue the whole Service, we give at least 30 days' notice and refund a pro-rata amount for any prepaid, unused period.

11. Limitation of liability

11.1. The Service is provided "as is". We are not liable for indirect damages, lost profits, lost customers or lost data, or for the results of messages or publications you approved.

11.2. In any case, our total liability will not exceed the amount you paid us in the 12 months before the event.

11.3. These limits do not apply to wilful misconduct or gross negligence, or where the law does not allow liability to be limited.

12. Indemnity

You will indemnify us against third-party claims arising from your breach of these Terms or of the law, including the anti-spam law and the Privacy Law, or from content you sent or published through the Service.

13. Changes to these Terms

We may update these Terms. We give at least 14 days' notice of a material change by email or in the app. Continued use after that date means you accept the new Terms.

14. Governing law

These Terms are governed only by the laws of the State of Israel. The competent courts in Ashdod have exclusive jurisdiction.
